By accessing or using staticDAM's website, software, or services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.
These terms apply to all visitors, users, and customers of staticDAM services.
staticDAM is open-source software released under the MIT License. This means you are free to:

Our paid concierge service includes setup, deployment, migration assistance, and priority support. By purchasing concierge services, you agree to the following:
The concierge service fee is a one-time payment. Payment is due upon agreement to proceed with services. We accept major credit cards and bank transfers.
Concierge services include initial setup, deployment to your infrastructure, migration of existing assets (where possible), team training, and one year of priority support. Custom development or extensive modifications are quoted separately.
Priority support is included for one year from the date of deployment completion. After the first year, you may continue independently (the software is yours), use community support, or purchase extended support.
When using staticDAM, you are responsible for:
Your content: You retain all rights to the digital assets you store and manage using staticDAM. We claim no ownership over your images, videos, or metadata.
Our software: The staticDAM software is released under the MIT License. The staticDAM name, logo, and branding are trademarks and may not be used without permission, except as required by the MIT License.
Website content: Content on our marketing website (excluding the open-source software) is protected by copyright and may not be reproduced without permission.
To the maximum extent permitted by law, staticDAM and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Our total liability for any claims arising from use of the software or services shall not exceed the amount you paid us in the twelve months preceding the claim.
The staticDAM software and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or completely secure.
For concierge services, if we are unable to complete the agreed-upon setup due to technical limitations on our end, we will provide a full refund. Once setup is complete and your system is deployed, refunds are not available. The open-source software is free and does not involve any payment.
We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the updated terms on this page. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
